1. Privacy Policy - Commitment to Discretion
Stemmed is the trading name of Abbie Austen-Saunders. We are committed to protecting the privacy and security of our clients. This policy outlines how we manage personal information in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Information Collection: We collect personal information (names, email addresses, phone numbers, and event details) solely through our enquiry form to facilitate bespoke floral commissions and creative consultations. Data Usage: Your data is used exclusively for communication regarding your specific project, processing bookings, and—where you have opted in—receiving our "Journal" or seasonal updates. Performance & Analytics: We utilize Squarespace Analytics to understand website traffic. This data is aggregated and anonymised, providing us with insights into how our "Archive" and "Journal" sections perform, allowing us to refine your digital experience. Data Security: We apply high technical standards to ensure your data remains secure. We will not sell or lend your data to third parties, nor do we consent to your information or our creative content being used by third-party providers for the training of AI modeling software. Collaborative Disclosure: To ensure the seamless execution of a commission, we may share relevant event details with third-party partners (e.g., event planners or venue coordinators). We do not share your personal contact information with these parties without your prior consent. Storage & Retention: Data is stored on secure, password-protected cloud platforms. We retain client data for three years following the completion of a commission to assist with future enquiries and statutory tax record-keeping. Your Rights: You have the right to access, correct, or request the erasure of your data at any time. Please direct any enquiries to contact@stemmed.co.uk. Third-Party Service Providers: We share limited personal data (name and email address) with Trustpilot to facilitate automated review invitations. This data is used solely for the purpose of triggering the invitation and is managed in accordance with Trustpilot’s own privacy standards.
2. Terms of Service - The Commission & Studio Standards
By engaging with our website and services, you agree to the following terms: Intellectual Property: All content, floral designs, and imagery featured on this website are the intellectual property of Stemmed. They may not be reproduced, redistributed, or used for commercial purposes without express written consent. Seasonality & Aesthetic Integrity: Floral arrangements are subject to nature’s availability. Stemmed reserves the right to make professional substitutions of equal or greater value to ensure the aesthetic integrity and quality of the final design. Booking & Contracts: An enquiry submitted via this website does not constitute a binding contract. A commission is only formalised once a bespoke quote is accepted, a booking fee is paid, and our formal Contract is signed. Booking & Retainers: A non-refundable booking fee is required to secure your date. Until this fee is received and the Contract is signed, the date remains available to other commissions. Final balances are due 21 days prior to the event date. Creative License: While we work closely with your brief, the final floral execution remains at the artistic discretion of Stemmed. We reserve the right to make adjustments to the design on-site to ensure the highest structural and aesthetic standards are met. Cancellations: Should a commission be cancelled, any costs already incurred (including but not limited to floral stock, specialist vessels, and administrative design time) will be charged in full. Cancellations within 14 days of the event are non-refundable and non-transferable. Installation Environment: Stemmed is not responsible for the longevity of floral displays if the environment is unsuitable (e.g., extreme heat, direct sunlight, or heavy drafts). Once the installation is complete and signed off, the care of the botanical elements is the responsibility of the client or venue. Professional Liability: Stemmed maintains professional standards in every installation; however, we are not liable for environmental factors or third-party interference beyond our control once a commission is installed. Governing Law: These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
